Clearwater Uninsured Motorist Lawyer
Despite the requirement for all drivers within the state of Florida to carry car insurance, many drivers forgo this duty, choosing to operate their vehicles without the required coverage. Not only is this risky for the uninsured driver–as they may not have Personal Injury Protection (PIP) coverage to pay for their harm in the event of a crash, and could be held personally liable for damages in crashes they cause–but it also risky for victims of uninsured drivers’ negligence. If you have been in a crash with an uninsured motorist, our Clearwater uninsured motorist lawyer at The Pawlowski//Mastrilli Law Group can help. Please reach out to us today to learn more about your options.
Uninsured or Not, You Have Personal Injury Protection (PIP) Coverage
The first thing that you should know about being in a crash is that regardless of the other driver’s insurance coverage, your Personal Injury Protection (PIP) coverage will pay for a portion of your losses. In fact, even if the other driver is at fault and is insured, state law requires that you turn to your own coverage first (per Florida’s no-fault system). PIP insurance will pay for at least $10,000 of your medical losses, if not more depending on the coverage limits you have purchased ($10,000 is the minimum).
Other Sources of Compensation
If the other driver is at-fault for your crash and is uninsured, and you have suffered serious injuries (providing you with the right to step out of the no-fault system), then there may be other sources of compensation available that you can consider. These include:
- Your health insurance coverage;
- Your uninsured/underinsured motorist coverage; and
- Your collision coverage.
You may also have the right to file a lawsuit for damages directly against the uninsured, at-fault driver. However, note that if the driver didn’t have insurance to begin with, they may not have the financial means and assets to pay for your damages, even if they are indeed liable for harm.
In addition to your own insurance company or filing a suit against the at-fault driver, when you work with our lawyers, we will also thoroughly investigate your claim to identify any other potentially at-fault parties. This might include a vehicle manufacturer, another third-party driver, a party responsible for road maintenance, etc. The more potential sources of compensation we can identify, the greater the chances are that you can recover the full damages award you’re entitled to.
